The general terms and conditions of business and use of the website patriciapie.eu (hereinafter: patriciapie.eu or Patricia Pie store) are composed in accordance with the Consumer Protection Act and other applicable legislation for online sales and such mode of business operation.

The terms and conditions govern the operation of the online store patriciapie.eu and the business relationship between Patricia Pie Barbara Franjić s.p. (hereinafter: Patricia Pie store, merchant, provider) and buyers of goods or services (hereinafter: buyers).

1. General about patriciapie.eu

The online store patriciapie.eu is intended for the sale of clothing, accessories, and merchandise.

By using the online store, the user agrees to the Terms and Conditions. The operator of the online store reserves the right to change the terms and conditions. If the user does not agree with the Terms and Conditions, the operator advises against using the website and store. The customer is reminded of the Terms and Conditions each time they place an order and must confirm, before submitting the order, that they have read and agree to them.

The content of the website may not be collected in databases or published in any form on other sites without the prior written consent of the operator.

2. Types of users

A visitor to the online store can browse the contents of the website as a “guest” or make a purchase without registration.

Upon placing an order in the online store, a visitor can provide the following personal information to the operator: name, surname, company name, country, street address, postal code, city, telephone number, email address. At the same time, they must confirm that they have read and agree to the applicable Terms and Conditions. When placing an order, the user can decide whether they wish to receive newsletters and/or promotional messages to the provided email address, from which they can unsubscribe at any time. Unsubscription from newsletters and/or promotional messages can be done by notifying the operator via email or by clicking on the unsubscribe link provided in the received email. The user’s personal data will only be used for the purpose of concluding a contract for the purchase in the online store and within the framework of voluntary consent for receiving newsletters and/or promotional messages. The retention period of the provided personal data is governed by the Privacy Policy.

3. Accessibility of information

The provider undertakes to always provide the customer with the following information:

  • contact details enabling fast and effective communication (email, phone),

  • essential characteristics of the goods or services, information about the use and purpose of the product (including after-sales services and warranties),

  • product availability (every product or service offered on the website should be available within a reasonable timeframe),

  • terms of sale, delivery of the product, or execution of the service (method, place, and delivery time),

  • all prices must be clearly and unambiguously stated, and it must be clearly indicated whether they include taxes and shipping costs,

3. Prices in the online store and conclusion of the sales contract

All prices are in EUR and include VAT. All orders delivered outside the European Union may be subject to potential taxes and customs duties, for which the buyer is responsible for payment.

The seller reserves the right to change the price unless otherwise stated (e.g., in the case of promotions and special discounts).

Until the purchase or the purchase or conclusion of the sales contract occurs when the buyer receives an order confirmation from the seller at the provided email address. From that moment onwards, all prices and other terms and information are fixed and apply to both the buyer and the seller.

Promotions

The validity periods of any ongoing promotions, which may vary, are stated alongside each promotional offer. Discounts do not accumulate unless otherwise stated in the terms of the promotion. With each purchase, it is possible to use one promotional code. Promotional codes cannot be applied to further reduce the price of already discounted items or the final price in the shopping cart.

Visual material and graphics

Photographs, images, or videos published as part of the offers are the property of the company Patricia Pie Barbara Franjić s.p. or its suppliers or business partners. The operator of the online store, in accordance with the Copyright and Related Rights Act in EU, reserves all copyrights and other intellectual property rights to the content of the website. Any unauthorized publishing, copying, reproduction, distribution, or other use of the content of this online store, not in accordance with these Terms and Conditions (and use), is strictly prohibited and will be prosecuted. User – consumer expressly guarantees that by posting content in the online store, no personal rights and intellectual property rights of third parties are infringed.

4. Purchase process and invoice

Patricia Pie, Barbara Franjić s.p. acts as a company offering goods or services online.

The buyer pays the amount to Patricia Pie, Barbara Franjić s.p., and along with the goods or services, they also receive an invoice to the email address provided during the order of the product or service. The company operates and ships products worldwide.

Due to environmental concerns, we have implemented an electronic invoicing system, where the customer receives invoices to their email address. The customer can still receive a printed invoice upon written request sent to the email address info@patriciapie.com.

The shipping cost includes all other handling charges and costs of cash transfer, so the courier should not charge any additional fees upon delivery. Your payment amount will be as stated on the confirmation invoice sent to your email address. Additional charges may apply for package pickup at a different address or at a parcel locker. You will be notified of this by the delivery service in advance. All orders shipped outside the European Union may be subject to customs duties and taxes, which the buyer is responsible for paying.

Purchase Process

The product ordering process begins by selecting products in the online store by clicking on the “Select Product” button. Then, a product page will open where you can choose the color, size, and desired quantity. Once you have selected the desired quantity and other characteristics, proceed with the purchase by clicking on the “Add to Cart” button. If you want to add more products, you can do so using the same process. If this was the only product you wanted to buy, click on the “View Cart” button. If you want to order more products, simply add another desired item to the cart or change the quantity of selected items in the cart. If you want to change any other characteristic of the selected product, you need to remove the incorrect item from the cart by clicking on the “X” on the left side of the product image. Then, you return to the store, find the desired product, select the correct characteristics, and add it back to the cart.

The cart clearly displays all items, their quantity, size, color, and the price of each item. The cart also shows the cost of shipping, as well as the total purchase amount. If you have a coupon or discount code, you can enter it in the designated area located below the list of selected items. Before placing the order, please verify that all the information is correct and agree with it, then proceed with the purchase by clicking on the “Proceed to Checkout” button.

At the checkout page, fill in the required information (mandatory fields are marked with *), and a summary of your entire order with prices and shipping costs will be displayed. The required details include: name, surname, company name (if applicable), country, address, city, postal code, phone number, and email address. Before completing the purchase, it is mandatory to confirm that you are familiar with the Terms of Service and Privacy Policy, select options regarding receiving newsletters and/or marketing messages, review your order and shipping costs, and then proceed by clicking on “Continue to Payment.” A secure payment page will open, where the buyer completes the purchase by entering their payment card details and confirming the payment. If the order has been successfully submitted, the buyer will see a message on the website saying: “Your order has been placed.”

After placing the order, the customer receives an email notification that the order has been received and that they will receive an email confirmation shortly. The buyer is obligated to verify the accuracy of the information before placing an order. Later objections regarding the accuracy of the data for invoice issuance will not be considered by the seller.

Order confirmed:

The provider reviews the received order, checks the availability of the ordered items, and either confirms the order or rejects it with a justified reason. The provider may call the customer on their contact phone number to verify information or ensure the accuracy of delivery. Upon confirming the order, the provider notifies the customer via email about the estimated delivery time.

If the customer wishes to cancel the order after it has been confirmed, they can do so by contacting info@patriciapie.com via email, until the ordered goods are dispatched. Orders for custom-made products Perfect Fit cannot be canceled after receiving the order confirmation notification.

The seller will prepare the goods for shipment within the agreed timeframe and dispatch them to the address provided by the buyer at the time of ordering. If the delivery or shipping time is unexpectedly extended after the order has been confirmed by the seller, the seller will notify the buyer via email using the email address provided by the buyer at the time of ordering.

Right of withdrawal from the purchase, return of goods

The consumer (a natural person purchasing an item for purposes outside their trade, business, or profession) has the right to notify the seller of withdrawal from the contract within 14 days of receiving the goods, by sending written notice to the contact address info@patriciapie.com In case of withdrawal from the contract, the consumer must return the item by mail to the seller’s address: Patricia Pie Barbara Franjić s.p., Male Dole 41, 3212 Vojnik. The consumer must, in the event of withdrawal, return the received item to the company immediately or no later than within 8 days from the date of sending the written notice of withdrawal.

The returned items must be unused, undamaged, in the original quantity, and in their original packaging with tags, unless the item is destroyed, defective, lost, or the quantity has diminished without the consumer’s fault. A copy of the invoice must be included with the returned item. The cost of returning the goods is covered by the buyer.

The seller refunds the full purchase price paid by the buyer as soon as possible, but no later than within 30 days from the receipt of the notice of withdrawal from the contract. In sales contracts, the seller may withhold the refund of received payments until the returned goods are received or until the consumer provides proof that the goods have been returned, whichever occurs first. For items sold as a set, the consumer may only withdraw from the entire set, meaning that they may request either the replacement of the entire set or a refund of the entire set’s purchase price. The consumer may only exchange an item that is part of a set in the case of a defect or damage to the item; they cannot request a refund for it.

The consumer does not have the right to withdraw from the contract for contracts where the subject is an item made according to the consumer’s precise instructions (like Perfect Fit), adapted to their personal needs, or due to its nature, it is not suitable for return. Example: A garment made and tailored to your specific measurements/preferences – Perfect Fit.

Misuse of purchase

After placing the order, the customer receives a notification to their email address provided during the order confirmation. The order has been placed in the queue. The customer has the right to withdraw from the distance contract until the goods are shipped (the order must be canceled by e-mail to info@patriciapie.com). It is mandatory to enter the order number. The email address from which the customer cancels the order must match the email address used to confirm the purchase. If the customer does not cancel the order, the order will be processed. When the order is confirmed, the supplier will notify the customer by e-mail about the expected delivery date.

Purchase security

Delivery time

The online store patriciapie.eu wants to meet the needs of its customers, therefore we deliver the purchased goods to your address in the EU or worldwide, in the shortest possible time from the receipt of the full payment of the purchase price, which is defined in the online store when ordering. Our authorized delivery service will call you in advance to arrange a specific day and time for delivery. For deliveries to other countries, you will be notified of the exact day and time of delivery by the delivery service. The shipping price to specific countries is defined in the order. Delivery of products is only on weekdays.

4. Payment Methods

  1. Payment card

In the online store patriciapie.eu, you can safely pay for ordered goods with a payment card. The payer must be the person or organization that owns the payment card. In cases where the cardholder is not a citizen of Slovenia and in cases where the recipient and the payer are not the same person, we reserve the right to additionally verify the identity of the payer and receive a written statement by e-mail or fax that the payer agrees to pay for the ordered goods. Once an order has been placed using this payment method, it is not possible to change the order content, the final amount, the delivery address and other agreed terms and conditions.

  1. Payment by proforma invoice.

After placing an order, the customer will receive an email with payment details. The customer will then make a bank transfer to the merchant’s account.

Until full payment for the products from each individual order, the ordered products remain the property of Patricia Pie Barbara Franjić s.p. Each order of items becomes valid after receipt of the full payment and is only then processed and shipped. The supplier shall send the customer, who has paid for his order, an invoice in PDF format to the e-mail address specified in the order. The invoice serves as proof for a complaint or return. . The customer may also receive a paper invoice upon delivery of the order.

5. Discounts and Discount Codes

If patriciapie.eu prepares promotions for customers with a promotional price or a discount code, the promotions are mutually exclusive, unless otherwise stated. Promotions and discount codes apply to items distributed by Patricia Pie Barbara Franjić s.p., unless otherwise stated.

8. Limitation of Liability

12. Final provisions

The obligation to notify about the change is fulfilled by appropriately publishing the current version of the Terms and Conditions on the website.
